These Terms & Conditions ("Terms") govern your use of cwcequip.com (the "Site"), operated by C.W.C Farm, Inc., doing business as C.W.C Heavy Equipment ("we," "us," "our"). By browsing the Site, submitting a form, or otherwise using it, you agree to these Terms. If you do not agree, please do not use the Site.

2. Who We Are

3. Eligibility

The Site is intended for use by individuals and businesses located in the United States who are at least 18 years old and legally able to enter into binding agreements. By using the Site, you represent that you meet these requirements.

4. Listings Are Not Offers

Equipment and consignment listings on the Site are informational only. They do not constitute a legal offer to sell, and are subject to change, prior sale, correction, and availability without notice. Photos, specifications, hours, and condition descriptions are provided in good faith but may contain errors — always confirm details directly with our team before relying on them.

5. Buy It Now Requests Are Inquiries, Not Purchases

Submitting a "Buy It Now" request, order form, or contact form is an expression of interest — it is not a binding purchase, and no payment is collected through the Site. A sale becomes final only once you and C.W.C Farm, Inc. separately agree on price, terms, and payment method, confirmed directly by phone or in writing with Alex or a member of our team.

6. Equipment Ownership & Consignment

Some equipment listed on the Site is owned directly by C.W.C Farm, Inc.; other equipment is listed on a consignment basis on behalf of third-party owners. The listing and our team will identify which applies. Different inspection, pickup, and delivery terms may apply depending on ownership type, as described on the relevant listing and our How To Buy Equipment page.

7. Pricing & Availability

Prices shown on the Site are estimates and subject to change without notice until confirmed in a final agreement. Shipping/delivery estimates generated by the Site's calculators are approximations based on distance and may differ from the final quoted cost.

8. Payment

We do not collect payment through this website. Payment terms and methods are agreed directly between the buyer and C.W.C Farm, Inc., and any payment instructions will be confirmed verbally by phone before you send funds. Be cautious of any communication claiming to be from us that pressures immediate payment without a prior phone conversation — verify by calling (123) 456-7890 before sending anything.

9. Delivery & Pickup

Delivery and trucking quotes shown on the Site are estimates until confirmed in writing. Actual pickup or delivery arrangements, timing, and cost depend on the specific equipment, its ownership status, and the terms agreed with our team.

10. Returns

Eligible equipment purchases may be covered by our 30-Day Buy Back Policy, which is incorporated into these Terms by reference. Where the terms of a specific purchase agreement differ from that policy, the signed purchase agreement controls.

11. Acceptable Use

You agree not to use the Site to:

• Submit false, misleading, or fraudulent information on any form.
• Attempt to gain unauthorized access to the admin dashboard, database, or any non-public part of the Site.
• Interfere with or disrupt the Site's normal operation, including through automated scraping, bots, or excessive requests.
• Copy, republish, or resell Site content for a commercial purpose without our written permission.
• Use the Site for any unlawful purpose.

12. Intellectual Property

The Site's text, photos, graphics, logos, and design are owned by or licensed to C.W.C Farm, Inc. and are protected by applicable intellectual property laws. You may view and print pages for personal, non-commercial reference, but may not otherwise reproduce or distribute Site content without our written permission.

13. Third-Party Links & Services

The Site may link to third-party services (for example, Google Maps or payment/telecom providers) that are outside our control. We are not responsible for the content, accuracy, or practices of those third-party services.

14. Disclaimer Of Warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except as expressly stated in a signed purchase agreement for a specific piece of equipment.

15. Limitation Of Liability

To the fullest extent permitted by law, C.W.C Farm, Inc. will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site. Our total liability for any claim relating to the Site itself will not exceed one hundred dollars ($100). This section does not limit liability arising from a separately signed purchase or consignment agreement for specific equipment, which is governed by its own terms.

16. Indemnification

You agree to indemnify and hold C.W.C Farm, Inc. harmless from any claim or demand, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.

17. Governing Law

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Site will be subject to the exclusive jurisdiction of the state or federal courts located in Idaho.

18. Changes To These Terms

We may update these Terms from time to time. The "Effective" date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
